My wife and I hired them in 2007 to take our photos for our wedding. They sent us an email two years later with the following language included "We understand that if you wish to share your images with family and friends online you have the right to, but we must be given the opportunity to give you the proper, authorized files with our logo." We asked for the "proper authorized files", but instead of sending the files, they complained to facebook, and had our pictures removed, and never sent us the authorized images. It was very upsetting that we paid these people $600 dollars for photos, but were made to feel like criminals for trying to share them with our friends and family on facebook. They acted like we were trying to sell the pictures and make money off of them or something, it was crazy. Those picutres are supposed to be a reminder of the best day of my life, but now when I look at them, all I can feel is a bunch of aggravation and fustration. Thanks FlickFoto

Vendor Response

In an attempt to make sure all of our clients we able to legally share photographs from their portrait sessions and events, we emailed them all (through blind carbon copy at the same time) sharing a new item we had made available to our new clients and would be more than willing to provide to them for no additional fee. Mr Armstrong requested a CD and we immediately processed and shipping one to his address. After he emailed us letting us know it had not been received, we confirmed with the postal service that it had in fact been damaged and was on its was back to our office. We immediately overnighted a second copy to him. Regarding Facebook: They, like all profile-based websites, have Terms and Conditions to which every user must abide by. A copyright agreement was enclosed with Mr Armstrong's original print CD which noted that internet files were not authorized, except on a personal website (since Mr Armstrong does not own, maintain, and manage Facebook, it is not considered his personal website; an example would be a wedding website or personal family album online). We have always been available to him and all of our clients to answer any questions to make sure that all of our policies are understood. It was not, and is not, our intention to make our clients feel this way about our business, let alone their wedding day. Every past client that has requested specific images via email or a full CD of images has been given one without question of prior internet sharing. We truly apologize to Mr Armstrong for his dissatisfaction in the way he feels we have handled the situation. We have in fact provided the CD which he originally requested and did not contact Facebook regarding his, or any other's client's images. All we were trying to do was make sure everyone was able to share in a legal way by us providing an authorized, optimized internet cd.
